Terms & Conditions

These General Terms and Conditions (hereinafter referred to as "GTC") of the company Coolkombinat e.K., Inhaber Dirk Heuer (hereinafter referred to as "Seller") shall apply to all contracts concluded between the Buyer (hereinafter referred to as "Client") and the Seller relating to all goods and/or services presented in the Seller's online store. The inclusion of the Customer's own terms and conditions is hereby rejected, unless otherwise agreed.
 
Scope of application
The business relationship concluded between the seller and the customer shall be governed exclusively by the following GTC in the version valid at the time of the order. Deviating conditions, amendments or additions to this contract are only effective if they have been confirmed in writing by the seller.
In the event that individual provisions of the following GTC become invalid, this shall not affect the validity of the remaining terms and conditions.
 
Delivery offer
Orders in our online store - with billing and delivery address in Germany - are only permitted for trade, companies, businesses, associations and freelancers within the meaning of § 14 BGB (German Civil Code).
Coolkombinat e.K. also delivers to all EU countries, Switzerland and Liechtenstein.
All offers of the seller regarding the availability of the goods are subject to change and non-binding.
 
Conclusion of contract
The contract language is German or English.
The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding online catalog. By clicking on the button "order for a fee" you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order is sent together with acceptance of the order immediately after it has been sent by an automated email. The purchase contract is concluded with this email confirmation. We will confirm receipt of your order by sending an email to the email address you provided on the order form. This email will again state the products ordered, their individual and total costs, any shipping costs incurred and the total amount of the order.
We are entitled not to accept orders. In this case you will be informed immediately.
 
Prices
The prices quoted in our online store are in euros (€), plus the statutory VAT (19%) ex warehouse Schömberg.
The offer is subject to change. Writing, printing and calculation errors as well as extraordinary price changes are reserved.
 
Terms of payment
The goods are usually delivered against Paypal, immediate bank transfer, direct debit, credit card payment or prepayment. For the payment option "prepayment" we grant a 2% discount. Cash payment with a 3% discount is also possible for collection in Schömberg. There is no obligation to deliver against invoice.
We also supply regular customers against invoice. The invoice amounts are then due within 10 days of receipt of the goods without deductions. In the event of late payment, the buyer is obliged to pay interest on arrears at an annual rate of 8% above the prime rate. The seller is also entitled to withhold deliveries from other orders - to a reasonable extent and scope - and only to make deliveries against advance payment without prior notice.
 
Terms of delivery
Delivery shall be made after receipt of payment. Partial deliveries are possible and will be agreed separately.
Delivery is made as quickly as possible; the delivery time is usually 3 - 4 working days from receipt of payment. As we cannot guarantee the delivery time of the transport company, the information on the delivery time is non-binding. We are free to choose the type of shipment and the means of transportation. If you require a delivery address that differs from the billing address, please inform us of this when placing your order.

The customer must notify the transport company and the seller of any complaints arising from transport damage immediately upon receipt of the goods. Please note any obvious defects directly on the delivery bill on receipt of the goods. You can inform us at +4970849350253 or at info@coolkombinat.de.
Returns of goods will only be accepted in full and in the original carton.
 
Shipping costs
Information on additional shipping costs can be found under Shipping.
For larger orders, we will prepare an individual shipping costs offer. Deliveries to countries not listed are at the expense of the buyer.
 
Retention of title
The delivered goods remain our property until full payment of the purchase price and settlement of all claims arising from the delivery contract.
If the buyer is in default of payment or culpably fails to fulfill other essential contractual obligations, the seller is entitled to withdraw from the contract in accordance with §§ 323, 440 BGB and to demand the return of the reserved goods or, if necessary, to demand assignment of the buyer's claims for return against third parties.
 
Offsetting and retention
You shall only have a right of set-off if your counterclaims have been legally established by a court of law or are undisputed or have been recognized by us in writing. You may only exercise a right of retention if the claims result from the same contractual relationship.
 
Notice of defects, liability
If there is a defect in the purchased item, the statutory warranty regulations shall apply.
Within 12 months of delivery, the seller shall provide a warranty for defects that are due to manufacturing or material defects; in the case of used appliances and demonstration appliances, the warranty claim shall be reduced to 6 months from the date of delivery (you may have further rights in accordance with your respective national borders). If the manufacturer of the delivery item grants a longer warranty period or a guarantee, we assign our rights from this to the customer/buyer at the time of purchase.
The rectification of defects, required spare parts and any replacement delivery are free of charge. The rejected goods must be sent to the seller - if available - in the original packaging or a substitute, professional packaging. At the Seller's request, the rejected item must be returned to the Seller carriage paid. If the complaint is justified, the seller shall reimburse the costs of the cheapest shipping method.

The Seller shall not assume any warranty for improper use, excessive wear and tear, incorrect assembly, unsuitable operating materials (electricity, cleaning agents, etc.) by the Buyer or other third parties. Furthermore, the seller shall not assume any warranty for damages arising in connection with the use of the delivered item; in particular, we shall not be liable for loss of profit or other financial losses of the buyer.
The warranty does not cover normal wear and tear or wearing parts and normal wear and tear. Obvious defects in the delivery must be reported immediately upon receipt. If this notification of defects is not made, the goods shall be deemed to have been approved and accepted in perfect condition (see also Terms of Delivery / Transport Damage).
 
Place of fulfillment and choice of law
The legal relationship between the seller and the customer shall be governed exclusively by the law of the Federal Republic of Germany. The Uniform Law on the International Sale of Goods shall not apply.
If the customer acts as a merchant, a legal entity under public law or a special fund under public law with its registered office in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered office of the seller. If the customer is domiciled outside the territory of the Federal Republic of Germany, the seller's place of business shall be the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the customer's professional or commercial activity. In the above cases, however, the seller is in any case entitled to appeal to the court at the customer's place of business.
